By accessing or using AffirmOS, creating an account, starting a free account or trial, purchasing a subscription, or using any related service, you agree to these Terms and Conditions.

AffirmOS is a branded white-label version built on a third-party software framework. Certain features, hosting, infrastructure, data processing, integrations, automations, and technical services may be provided, powered, or supported by third-party technology providers.
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an AffirmOS account.
By using AffirmOS, you represent that:
You are legally able to enter into these Terms.
The information you provide is accurate and complete.
You will use the platform lawfully.
You are responsible for your account activity.
You have authority to act on behalf of any business or organization you register.
4. Account Registration and Security
To use certain features, you may be required to create an account.
You agree to:

Keep your login credentials secure.
Not share your account in an unauthorized manner.
Notify us promptly of unauthorized access or suspected security issues.
Accept responsibility for all activity under your account.
AffirmOS is not responsible for losses caused by your failure to protect your account credentials.
5. Free Accounts, Trials, Subscriptions, and Billing
AffirmOS may offer free accounts, free trials, paid plans, promotional offers, or subscription-based services.
By selecting a paid plan or entering payment information, you authorize AffirmOS and/or its payment processors to charge the applicable fees according to the plan, billing cycle, and terms presented at checkout.
Subscription terms should be clearly disclosed before purchase. The FTC has emphasized that negative-option programs, including automatic renewals and free trials, should provide clear disclosures and simple cancellation mechanisms.
Billing
You agree to pay all fees associated with your selected plan. Fees may be billed monthly, annually, or according to another billing cycle disclosed at checkout.
Automatic Renewal
Unless canceled before the renewal date, paid subscriptions may renew automatically. By purchasing a recurring subscription, you authorize recurring charges until you cancel.
Failed Payments

Taxes
You are responsible for any applicable taxes, duties, levies, or government charges associated with your purchase or use of AffirmOS.
6. Cancellation Policy

Cancellation stops future billing, but it may not automatically trigger a refund unless required by law or stated in our refund policy.
We aim to make cancellation clear and reasonably accessible. FTC guidance on recurring subscriptions highlights the importance of making cancellation straightforward for consumers.
7. Refund Policy
Unless otherwise stated at checkout or required by applicable law, subscription fees and digital service payments are non-refundable after payment is processed.
AffirmOS may, at its discretion, provide refunds, credits, or account adjustments in specific cases.

8. Acceptable Use
You agree not to use AffirmOS for unlawful, harmful, deceptive, abusive, or unauthorized purposes.
You may not use AffirmOS to:
Violate any law, regulation, or third-party right.
Send spam, deceptive emails, or unlawful marketing messages.
Misrepresent your identity, business, product, service, or offer.
Make false, misleading, or unsubstantiated claims.
Sell illegal, restricted, or prohibited products or services.
Upload malware, viruses, harmful code, or malicious files.
Attempt to hack, disrupt, overload, or reverse engineer the platform.
Scrape, harvest, or misuse data without permission.
Impersonate another person, brand, business, or organization.
Promote fraud, scams, hate, exploitation, harassment, or abuse.
Violate payment processor, email provider, hosting, or third-party platform rules.
We reserve the right to suspend or terminate accounts that violate these Terms.
9. Marketing, Advertising, and User Claims
You are responsible for all claims, statements, testimonials, guarantees, earnings examples, income claims, health claims, ministry claims, transformation claims, business claims, and advertising messages you publish using AffirmOS.
You agree that your marketing must be truthful, not misleading, and supported by appropriate evidence where required. The FTC’s advertising guidance says claims must be truthful, not deceptive or unfair, and evidence-based when appropriate.
You are responsible for complying with applicable advertising, consumer protection, email marketing, privacy, and industry-specific laws.
AffirmOS does not guarantee that your funnels, websites, emails, offers, automations, ads, testimonials, or sales pages comply with applicable law.
10. Email Marketing and Communications Compliance
If you use AffirmOS to send emails, collect leads, manage subscribers, or run automations, you are responsible for complying with all applicable email marketing laws and regulations.
You agree to:
Only email people you have permission to contact.
Use accurate sender information.
Avoid deceptive subject lines.
Include required disclosures where applicable.
Honor unsubscribe requests.
Maintain appropriate consent records.
Avoid spam, phishing, or deceptive messaging.
AffirmOS may suspend email sending privileges or account access if we believe your activity harms deliverability, violates law, or breaches platform standards.
11. User Content
You retain ownership of the content you create or upload to AffirmOS, including text, images, videos, course content, digital products, funnels, websites, emails, automations, forms, and other materials.
By using AffirmOS, you grant us a limited license to host, store, process, display, transmit, and deliver your content as necessary to provide the platform and related services.
You represent that you have all necessary rights, licenses, permissions, and consents to upload and use your content.
You are solely responsible for your content and for any claims arising from it.
12. Prohibited Content
You may not upload, publish, sell, promote, or distribute content that:
Is illegal or fraudulent.
Infringes intellectual property rights.
Contains malware or harmful code.
Promotes violence, exploitation, or abuse.
Contains deceptive financial, health, business, or earnings claims.
Violates privacy or publicity rights.
Encourages unlawful activity.
Violates payment processor, email provider, or platform partner rules.
Is otherwise determined by AffirmOS to be harmful to users, the platform, or our partners.
13. Customer, Subscriber, and Lead Data
If you collect information from your own leads, customers, clients, students, subscribers, or members through AffirmOS, you are responsible for that data.
You agree to:
Collect data lawfully.
Provide required privacy notices.
Obtain consent where required.
Protect your customer and subscriber data.
Use data only for lawful purposes.
Honor deletion, unsubscribe, and privacy requests where required.
Maintain your own privacy policy if needed.
AffirmOS may process this data to provide platform services, but you remain responsible for your business’s use of that data.

Your use of AffirmOS is also governed by our Privacy Policy.

Businesses are encouraged by the FTC to understand what personal information they collect, limit what they keep, protect it, and use reasonable safeguards.
15. Platform Availability and Changes
AffirmOS may update, modify, suspend, discontinue, or limit any feature, tool, service, plan, integration, or functionality at any time.
We do not guarantee uninterrupted, error-free, or continuous availability of the platform.
Temporary downtime may occur due to maintenance, updates, outages, security issues, third-party provider interruptions, or events beyond our control.
16. Third-Party Services and Integrations
AffirmOS may rely on or connect with third-party services, including payment processors, email providers, hosting providers, domain registrars, analytics tools, automation providers, and platform infrastructure providers.
Your use of third-party services may be subject to their own terms, privacy policies, fees, and restrictions.
AffirmOS is not responsible for third-party service failures, outages, data practices, policy changes, fees, or actions.
17. White-Label Platform Disclosure
AffirmOS is a branded white-label version of a third-party SaaS framework. Certain features and services may be powered by, hosted by, maintained by, or integrated with third-party software providers.
By using AffirmOS, you understand that technical functionality, availability, updates, feature limits, and service performance may depend in part on third-party systems and infrastructure.
AffirmOS makes no claim of exclusive ownership over the underlying third-party framework, software infrastructure, or platform technology that powers white-label functionality.
18. Payments and Payment Processors
AffirmOS may allow you to sell products, services, subscriptions, courses, memberships, digital downloads, or offers through payment integrations.
You are responsible for:
Setting accurate prices.
Delivering what you sell.
Handling customer service.
Managing refunds and disputes.
Complying with tax obligations.
Complying with payment processor rules.
Avoiding fraudulent or misleading transactions.
AffirmOS is not responsible for chargebacks, failed payments, customer disputes, tax filings, or payment processor account limitations related to your business activity.
19. Intellectual Property
AffirmOS, including its name, logo, brand assets, designs, copy, graphics, platform materials, training resources, and related content, is owned by AffirmOS or its licensors and is protected by intellectual property laws.
You may not copy, reproduce, resell, distribute, modify, or create derivative works from AffirmOS brand assets or proprietary materials without written permission.
You may not use the AffirmOS name or branding in a way that suggests endorsement, partnership, or ownership without authorization.
20. No Guarantee of Results
AffirmOS provides tools to help you build, launch, market, sell, and manage online business assets.
We do not guarantee income, sales, leads, business growth, audience growth, spiritual outcomes, ministry results, customer conversions, deliverability, search ranking, or any specific result.
Your results depend on many factors, including your offer, audience, message, market, pricing, consistency, compliance, strategy, and execution.
Any examples, testimonials, or case studies are illustrative and do not guarantee that you will achieve similar results.
21. Educational and Informational Content
Any training, guidance, templates, resources, examples, coaching materials, or educational content provided through AffirmOS are for informational and educational purposes only.
They are not legal, financial, tax, medical, psychological, investment, or professional advice.
You should consult qualified professionals before making decisions that require specialized advice.
22. Testimonials and Endorsements
If AffirmOS uses testimonials, reviews, case studies, or endorsements, we aim to present them truthfully and with appropriate context.
If you provide a testimonial, review, comment, or endorsement, you grant AffirmOS permission to use it for marketing, educational, or promotional purposes, unless otherwise agreed in writing.
Advertisers are responsible for ensuring endorsements and testimonials are not misleading and comply with FTC guidance.

However, no online platform, storage system, or transmission method is completely secure.

24. Suspension and Termination
We may suspend, restrict, or terminate your account if:
You violate these Terms.
You fail to pay required fees.
Your activity creates risk to AffirmOS, users, partners, or third-party providers.
You engage in fraud, abuse, spam, or unlawful conduct.
Your content violates our acceptable use standards.
We are required to do so by law or by a third-party provider.
Upon termination, you may lose access to your account, content, websites, funnels, courses, automations, contacts, and related data.
You are responsible for exporting or backing up your content and data where platform functionality allows.

Account deletion may be subject to identity verification, outstanding payment obligations, legal retention requirements, fraud prevention needs, backup retention, or technical limitations.

26. Disclaimer of Warranties
AffirmOS is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and uninterrupted operation.
We do not warrant that AffirmOS will be error-free, secure, uninterrupted, or meet every business need.
27. Limitation of Liability
To the fullest extent permitted by law, AffirmOS, its owners, officers, team members, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages.
This includes damages related to:
Lost revenue
Lost leads
Lost customers
Lost data
Platform downtime
Email deliverability issues
Payment disputes
Third-party service interruptions
Security incidents
Business interruption
Use or inability to use the platform
To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid to AffirmOS in the three months before the claim arose, or $100 if you used only a free account.
Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
28. Indemnification
You agree to indemnify, defend, and hold harmless AffirmOS, its owners, officers, team members, contractors, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

Your content
Your products, services, offers, or business activity
Your violation of these Terms
Your violation of law
Your violation of third-party rights
Your marketing, emails, funnels, websites, courses, or automations
Your collection or use of customer, lead, subscriber, or member data
29. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.
Any disputes will be handled in the courts located in Cobb County, Georgia, unless applicable law requires another venue.
30. Dispute Resolution
Before filing any legal action, you agree to contact us first and attempt to resolve the issue informally.
